DEFINITIONS In this agreement:
  • "Hosterowl" refers to the domain hosting service provided by Hosterowl Inc.
  • "Customer" refers to the person or entity that uses Hosterowl's domain hosting service.
  • "Agreement" refers to these terms and conditions, as well as any other policies or guidelines referenced in this agreement.
    1. SERVICES PROVIDED Hosterowl provides domain hosting services to its customers. These services may include, but are not limited to, domain registration, web hosting, email hosting, and other related services.
    2. ACCOUNT SETUP Customers must create an account with Hosterowl to use its services. Customers must provide accurate and complete information during the account setup process, and keep their account information up-to-date at all times.
    3. PAYMENT Customers are responsible for paying all fees associated with their use of Hosterowl's services. Fees may include, but are not limited to, domain registration fees, web hosting fees, and other related fees. Payment may be made by credit card, PayPal, or other payment methods accepted by Hosterowl. Fees are non-refundable, except as otherwise provided in this agreement.
    4. TERM AND TERMINATION This agreement shall remain in effect until terminated by either party. Customers may terminate this agreement at any time by providing written notice to Hosterowl. Hosterowl may terminate this agreement at any time for any reason, including, but not limited to, violation of this agreement or applicable laws and regulations.
    5. CUSTOMER RESPONSIBILITIES Customers are responsible for complying with all applicable laws and regulations, as well as Hosterowl's policies and guidelines. Customers must use Hosterowl's services in a manner that is consistent with these policies and guidelines, and must not use Hosterowl's services for any illegal or unethical purposes.
    6. REFUND POLICY
      1. Refund Eligibility Customers may be eligible for a refund under the following circumstances:
        1. Hosterowl fails to provide the agreed-upon services.
        2. Customer terminates the agreement within a specified refund period, as determined by Hosterowl's policies.
      2. Refund Request Process: To request a refund, customers must submit a written request to Hosterowl's customer support within the specified refund period. The request must include details about the reason for the refund.
      3. Refund Processing Time: Refunds, if approved, will be processed within a reasonable time frame. The processing time may vary depending on the payment method used by the customer.
      4. Non-Refundable Fees: Certain fees, such as domain registration fees and setup fees, are non-refundable unless explicitly stated otherwise in this agreement.
      5. Dispute Resolution: In case of any disputes related to refund requests, Hosterowl and the customer agree to engage in good-faith negotiations to resolve the issue amicably.
      HOSTING TERMS
      1. Service Availability Hosterowl will make reasonable efforts to ensure the availability of its hosting services. However, customers acknowledge that occasional downtime may occur due to maintenance, upgrades, or unforeseen circumstances.
      2. Resource Usage: Customers must use Hosterowl's hosting resources responsibly and in accordance with the allocated limits specified in their hosting plan. Excessive usage that negatively impacts server performance may result in account suspension or termination.
      3. Data Backups: While Hosterowl may provide regular backups, customers are responsible for maintaining their own backups. Hosterowl shall not be liable for any data loss or corruption.
      4. Prohibited Content:Customers agree not to host or transmit any content that violates applicable laws, infringes on intellectual property rights, or is deemed inappropriate by Hosterowl. This includes but is not limited to content that is defamatory, obscene, or harmful.
      5. Security: Customers are responsible for maintaining the security of their accounts, including passwords and authentication information. Any unauthorized access or security breaches must be reported to Hosterowl immediately.
      6. Technical Support: Hosterowl will provide reasonable technical support to customers. The scope and methods of support may be outlined in separate policies or guidelines.
      7. Migration: Customers seeking to migrate their hosting services to or from Hosterowl may be subject to additional fees and requirements. Details will be provided by Hosterowl upon request.
    7. WARRANTY DISCLAIMER Hosterowl provides its services on an "as is" basis and makes no warranties, express or implied, regarding its services, including, but not limited to, any warranties of merchantability or fitness for a particular purpose.
    8. LIMITATION OF LIABILITY Hosterowl shall not be liable for any damages arising out of or in connection with the use of its services, including, but not limited to, any direct, indirect, incidental, or consequential damages.
    9. INDEMNIFICATION Customers agree to indemnify and hold Hosterowl and its affiliates, officers, directors, employees, and agents harmless from any claims, damages, liabilities, or expenses arising out of or in connection with the use of Hosterowl's services.
    10. GOVERNING LAW This agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which Hosterowl is located.
    11. MODIFICATION Hosterowl may modify this agreement at any time by posting the modified agreement on its website. Customers are responsible for reviewing the modified agreement and agreeing to its terms.
    12. ENTIRE AGREEMENT This agreement constitutes the entire agreement between Hosterowl and the customer with respect to the subject matter hereof, and supersedes all prior agreements and understandings, whether written or oral.
